Rex MD is an online health platform which offers men’s health telehealth consultations and direct-to-consumer medication orders. To use Rex MD, visitors to Rex MD’s website are directed to answer eligibility questionnaires and prompted to create an account, and which point they can schedule telehealth consultations with physicians and receive prescriptions for medications which they can order for delivery by mail.

Labaton Keller Sucharow and Levin Law are investigating whether Rex MD users had their personal, sensitive health information shared with third parties without their knowledge or consent in violation of their privacy rights and certain state laws. Consumer privacy publication The Markup published the results of its investigation into the data sharing practices of 50 online telehealth companies. It revealed that Rex MD shares its users’ personal, sensitive information including personal information (e.g. full name, email, phone), the URLs on the Rex MD website that were visited, and what medications the user added to their virtual shopping cart with third party analytics companies like Google, Facebook, Bing, TikTok, and Snapchat. Because this information is associated with healthcare, it is especially sensitive and given heightened protection by state laws.
